1. Introduction
Welcome to PraxisCommons ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at praxiscommons.sbs (the "Service") operated by PraxisCommons.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you do not agree with any part of these terms, you are not permitted to use the Service.
2. Service Overview
PraxisCommons offers top-tier yacht charter services, which include, but are not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
All services are offered subject to availability and weather conditions. We may change or terminate services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For a charter reservation, you are required to:
- Be at least 18 years of age
- Provide accurate and comprehensive information
- Remit the necessary deposit as outlined in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A booking is confirmed with the receipt of your payment and provision of our written confirmation. Reservation of service is subject to our discretion.
3.3 Availability
Charter services depend on vessel availability and suitable weather conditions. We endeavor to accommodate your desired dates and times where possible.
4. Payment Terms
4.1 Pricing
All listed prices are in € and tax-inclusive unless otherwise specified. We reserve the right to alter prices without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the entire charter cost due at the time of booking
- Final Payment: Due 48 hours before the charter's scheduled departure
- Supplementary expenses (if applicable): Payable at the charter's end
4.3 Payment Methods
Payments can be made using major credit cards, bank transfers, and certified cheques. We ensure secure payment processing through encrypted methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With more than 72 hours before departure: Full refund minus processing charges
- Between 24 to 72 hours before departure: 50% refund
- With less than 24 hours before departure: No refund available
5.2 Weather Cancellations
In case of unsafe weather conditions as determined by our captain, we will propose to:
- Reschedule the charter to an alternative date without additional costs
- Provide a complete refund if rescheduling is unfeasible
5.3 Mechanical Issues
Should there be mechanical issues with the assigned yacht, we will attempt to provide an appropriate replacement. If unavailable, a full refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Heed all instructions from the crew
- Wear the safety gear provided when necessary
- Notify of any health conditions that may affect their safety
- Stay within permitted areas on the vessel
6.2 Prohibited Items
The subsequent items are not allowed on the yacht:
- Glass containers
- Illegal substances
- Firearms or weapons
- Excessive non-alcoholic drinks
- Pets (except with prior authorization)
6.3 Conduct
Guests are expected to act respectfully at all times. We maintain the right to end a charter prematurely without refund if a passenger's behavior is a safety concern or disrupts the journey for others.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the charter's paid amount and do not account for:
- Injuries due to passenger negligence
- Personal property loss or damage
- Indirect, consequential, or exemplary damages
- Delays from weather or other uncontrollable factors
7.2 Insurance Coverage
Our vessels and operations are insured under comprehensive marine insurance. Passengers should arrange for their own travel and personal insurance.
7.3 Assumption of Risk
Participation in our yacht services indicates an understanding of the inherent risks involved in marine activities and an acceptance of personal responsibility for safety and risk.
8. Modifications and Itinerary Changes
We retain the right to adjust itineraries, routes, or timetables based on climatic conditions, safety requirements, or other operational considerations. We strive to offer comparable alternatives when necessary.
9. Force Majeure
Events beyond our control, which may cause delays, cancellations, or amendments include, but are not limited to:
- Severe weather conditions
- Natural disasters
- Government edicts
- Harbor closures
- Unforeseen mechanical failures
10. Privacy and Data Protection
Your personal details are processed in line with our Privacy Policy. Utilizing our services indicates consent to the data collection and usage described in our Privacy Policy.
11. Intellectual Property
Content on our website, such as texts, visuals, trademarks, and imagery, is protected by copyright and must not be duplicated, distributed, or altered without our written consent.
12. Governing Law
These Terms are regulated by the laws of Germany. Conflicts will be adjudicated in Hamburg, Germany.
13. Changes to Terms
We may revise these Terms when necessary. Amendments will be published on our website and tagged with the new revision date. Continued use post-amendment implies acceptance of the new terms.
